RIGHT TO RESIDENCE - HOUSES SEALED WITHOUT NOTICE AND ORDER
i would like to draw your kind attention towards the issue related to houses which were sealed on 5th of september 2013 by the estate officer's in village raipur khurd, chandigarh without giving any notice to vacate the same and without specific order's from higher authorities deal with the said matters and both houses used for residential purposes from the last more than 2 years and already in the knowledge of chandigarh administration and when the houses were seales families residing there and still there households and daily used articles lying with sealed houses and the day on which said house was sealed one person sleeping inside the house but by ignoring all this the estate office employee does not bother all about this and this is violation of human rights on the end of estate officials of chd, admin. and this act is against the pricipal of natural justice and violation of human rights under article 19-21 of constitution which vilolated fundamental rights of one which describe right to residence(shelter)etc.and this matter already in the knowledge of concerned departments but nobody wants to take any remedial action to open the seal of houses i village raipur khurd, chandigarh. and persons to whom these houses belongs right after this act had applied for certified copy of any order for taking action w.r.t sealing of houses but department officials refused to provide that by saying we need not to get any order from higher authority because land acquisition officer was present on the spot and he himself is higher authority and one more thing where the said houses were constructed or sealed by department officials the same land is never acquired by chandigarh administration and now the question arises the land which was not acquired by chandigarh administration how the department officials can take any action against them for doing such kind of illegal activity like demolition as well as sealing of houses.
kindly consider this matter on priority and resolve it as early as possible.
and pass appropriate orders to open the seal so that residents as well tenants therein reside peacefully with their families otherwise they are forced to spend their nights outside the houses.
